This Return & Refund Policy (“Policy”) constitutes a legally binding agreement between you (“Customer,” “you,” or “your”) and SmartBuyGadgets (“Company,” “we,” “our,” or “us”), governing purchases made through SmartBuyGadgets.com (the “Website”).

By placing an order on our Website, you acknowledge that you have read, understood, and agreed to this Policy.


1. SCOPE OF APPLICATION

This Policy applies to all purchases made through SmartBuyGadgets.com and shipped to customers located in:

  • The United States

  • Canada

  • The United Kingdom

  • Select international destinations where we ship

This Policy is incorporated by reference into our Terms & Conditions.


2. 14-DAY RETURN PERIOD

You have fourteen (14) calendar days from the date of delivery to request a return.

For customers located in the United Kingdom and applicable European regions, this policy complies with the Consumer Contracts Regulations 2013, which provide a statutory 14-day cancellation period for distance selling.

Failure to request a return within this period voids eligibility, except where required by mandatory local law.


3. CONDITIONS FOR ELIGIBLE RETURNS

To qualify for a return:

  1. The item must be unused, unworn, and in original condition.

  2. All original packaging, manuals, accessories, and protective seals must be intact.

  3. Proof of purchase must be provided.

  4. A Return Authorization (RA) must be issued by SmartBuyGadgets before shipment.

We reserve the sole right to determine whether returned goods meet eligibility requirements.


4. NON-RETURNABLE ITEMS

The following items are strictly non-returnable:

  • Opened or used in-ear audio products (earbuds/earphones) due to hygiene and safety regulations

  • Digital downloads, activation codes, or software licenses

  • Gift cards

  • Clearance or final sale items

  • Custom-built or personalized products

Statutory rights under applicable law remain unaffected.


5. DEFECTIVE OR DAMAGED GOODS

If an item arrives damaged, defective, or incorrect:

  • You must notify us within 48 hours of delivery.

  • You must provide photographic or video evidence.

  • We may require return inspection prior to issuing a remedy.

Upon verification, we will, at our sole discretion:

  • Replace the product, OR

  • Repair the product, OR

  • Issue a full refund

Return shipping costs for confirmed defective or incorrect items will be covered by SmartBuyGadgets.


6. RETURN PROCEDURE

To initiate a return:

  1. Contact support@smartbuygadgets.com

  2. Provide your order number and reason for return

  3. Await written Return Authorization (RA)

  4. Ship the item to the designated return address

Unauthorized returns may be refused and returned at the sender’s expense.

We recommend insured and trackable shipping. We are not responsible for lost or damaged return shipments.


7. REFUNDS

Upon receipt and inspection of the returned item:

  • Refunds will be processed within 5–10 business days.

  • Refunds will be issued to the original method of payment.

  • Original shipping charges are non-refundable unless required by law or due to Company error.

Processing times may vary depending on financial institutions.


8. INTERNATIONAL RETURNS

For international orders:

  • Customers are responsible for return shipping costs unless the item is defective.

  • Customs duties, VAT, import taxes, and brokerage fees are non-refundable.

  • The Customer assumes responsibility for compliance with local import/export regulations.


9. CANCELLATIONS

Orders may be canceled within twelve (12) hours of purchase provided they have not been processed or shipped.

Once shipped, the order is subject to this Return & Refund Policy.


10. CHARGEBACKS AND FRAUD PREVENTION

Customers agree to contact SmartBuyGadgets before initiating a chargeback.

Fraudulent chargebacks or disputes may result in:

  • Account suspension

  • Collection proceedings

  • Legal action

We reserve all rights to dispute chargebacks with supporting delivery confirmation and transaction records.


11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

SmartBuyGadgets shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits or business interruption

  • Damages arising from misuse of products

Nothing in this Policy excludes liability where prohibited by law, including death or personal injury caused by negligence.


12. GOVERNING LAW

This Policy shall be governed by and construed in accordance with:

  • The laws of the United States (for U.S. customers)

  • Applicable provincial laws in Canada (for Canadian customers)

  • The laws of England and Wales (for UK customers)

Any disputes shall be subject to the exclusive jurisdiction of the courts applicable to the customer’s place of residence, unless otherwise required by mandatory consumer protection laws.


13. SEVERABILITY

If any provision of this Policy is found unenforceable, the remaining provisions shall remain in full force and effect.


14. MODIFICATIONS

We reserve the right to update or modify this Policy at any time. Changes take effect immediately upon posting on the Website.
